DATA PROCESSING AGREEMENT

1. Roles and Responsibilities

When using QubitX Intelligence services, the parties may act in different roles regarding personal data processing.

• Customer / Client – Acts as the Data Controller responsible for determining how and why personal data is processed.
• QubitX Intelligence – Acts as the Data Processor responsible for processing data on behalf of the controller.

QubitX processes data only in accordance with documented instructions from the data controller.

2. Purpose of Data Processing

QubitX Intelligence processes personal data solely for the purpose of delivering platform services and maintaining system functionality.

• Providing AI-powered services and infrastructure tools
• Maintaining system security and operational reliability
• Supporting customer service and technical assistance
• Improving platform functionality and performance

Personal data will never be sold or used for unrelated purposes.

3. Types of Data Processed

Depending on how the platform is used, QubitX Intelligence may process certain categories of information including:

• User account information
• Professional contact details
• Platform usage and system interaction data
• AI system inputs and generated outputs

Data processing is limited strictly to the data necessary to operate platform services.

4. Security Measures

QubitX Intelligence implements strong technical and organizational safeguards designed to protect personal data against unauthorized access, alteration, or loss.

• Encrypted communication channels (HTTPS / TLS)
• Secure cloud infrastructure architecture
• Role-based access controls for internal systems
• Continuous monitoring and security auditing

Security controls are regularly evaluated and updated to address emerging threats.

5. Data Confidentiality

All employees, contractors, and partners who have access to personal data processed by QubitX Intelligence are bound by strict confidentiality obligations.

Access to personal data is limited only to individuals who require such access for operational purposes.

6. Subprocessors

QubitX Intelligence may engage trusted infrastructure providers or service partners to assist in delivering platform services.

All subprocessors are required to maintain security standards and confidentiality obligations consistent with this Data Processing Agreement.

7. Data Retention

Personal data processed through the QubitX Intelligence platform is retained only for as long as necessary to provide services and comply with legal or operational obligations.

Upon termination of services, data may be deleted or returned according to applicable contractual agreements.

8. Data Subject Rights

Individuals whose data is processed through the QubitX platform may have rights under applicable data protection laws, including the right to:

• Access personal data
• Request correction of inaccurate information
• Request deletion of personal data
• Restrict or object to certain types of processing

Requests should be directed to the relevant data controller or submitted through the appropriate contact channels.

9. Incident Response

QubitX Intelligence maintains procedures for detecting, reporting, and responding to potential data security incidents.

If a confirmed data breach occurs, affected customers will be notified in accordance with applicable legal requirements.
